<li>It&#8217;s finally done. Comcast has announced a deal that will give the company a 51% stake in NBC Universal. Here&#8217;s THR&#8217;s <a href="http://www.hollywoodreporter.com/hr/content_display/news/e3i6328aaffeb014c136cf02085b9f96be0">deal announcement story,</a> as well as an analysis of the <a href="http://www.hollywoodreporter.com/hr/content_display/news/e3i6328aaffeb014c1396fbba5a8d506e7c">regulatory review</a> to come. Comcast is represented by a team of lawyers at Davis Polk &amp; Wardwell in the deal. GE and NBC were advised by lawyers at Weil, Gotshal &amp; Manges. Vivendi was represented by lawyers at Gibson, Dunn &amp; Crutcher.</li>
<li>In unrelated news, <a href="http://www.hollywoodreporter.com/hr/content_display/news/e3iefbf4e9d9f602fce50da69d8a12cfb2e?">NBC announced the departure</a> of business affairs chief Rick Olshansky. For now, the division will be headed by NBCU TV president Marc Graboff, who formerly administered the division before being elevated in 2007.</li>
<li>AT&amp;T and Verizon have agreed to back off from their legal war over similar advertisements. AT&amp;T, producers of the &#8220;There&#8217;s an App for That&#8221; commercial, sued Verizon over the &#8220;There&#8217;s a Map for That&#8221; campaign. Two weeks ago, a court declined AT&amp;T&#8217;s motion to stop Verizon&#8217;s ads. So AT&amp;T, suffering from some bad PR from being litigious, has <a href="http://digitaldaily.allthingsd.com/20091202/court-dimisses-atts-lawsuit-against-verizon/">decided to withdraw its lawsuit</a>.</li>
<li>Redbox has <a href="http://www.videobusiness.com/article/CA6709472.html">added a new claim</a> to antitrust lawsuits against Twentieth Century Fox and Warner Home Video. The cutthroat DVD kiosk vendor filed papers in court accusing the two studios of retail interference, saying chains like Wal-mart, Target and Best Buy are limiting the number of DVDs it can buy. In August, <a href="http://www.thresq.com/2009/08/redbox-hollywood-antitrust.html">a judge dismissed a similar tortious interference claim</a> against Universal.</li>
<li>A court in Sweden has <a href="http://www.wired.com/threatlevel/2009/12/torrent-tracker-lives/">denied the entertainment industry&#8217;s attempts</a> to order a Swedish ISP from cutting off access to OpenBitTorrent, which the studios claim is The Pirate Bay&#8217;s new torrent tracker.</li>

The takeover is <a href="http://www.bloomberg.com/apps/news?pid=20601087&amp;sid=aZso6rU.A1dI&amp;pos=5">expected to draw intense regulatory scrutiny</a> from the FCC, FTC, Justice Department, and Congress. Lawyers for Comcast will likely need to show that the new company won&#8217;t undermine competition with other pay-TV services by withholding programming or by <a href="http://latimesblogs.latimes.com/entertainmentnewsbuzz/2009/11/should-nbc-affiliates-be-wary-about-comcast-deal.html">shaking up deals with NBC affiliates</a>. Some are even beginning to question <a href="http://mashable.com/2009/12/01/comcast-hulu/?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+Mashable+%28Mashable%29">what the deal means for the future of online video</a> as NBCU holds a significant stake in Hulu.</li>
<li>A Massachusetts judge has <a href="http://latimesblogs.latimes.com/entertainmentnewsbuzz/2009/12/sumner-redstone-prevails-in-latest-family-feud.html">handed media mogul Summer Redstone a legal victory</a> against his nephew, Michael, who claimed he was unfairly deprived of shares worth millions of dollars in National Amusements, a holding company through which Summer owns controlling stakes in CBS and Viacom. Judge Hinkle ruled that the plaintiff had not met the burden of proving the creation of an oral trust in 1959.</li>
<li>The Smashing Pumpkins have <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3i8a9b19a7752dca15e6ec7e04557febab">settled a pair of lawsuits</a> filed against Virgin Records over use of the band&#8217;s songs in promotions. Terms of the settlement weren&#8217;t disclosed.</li>
<li>The National Association of Broadcast Employees is <a href="http://www.thrfeed.com/2009/12/nbc-threatened-with-christmas-special-shutdown-.html">threatening to pull the plug</a> on NBC&#8217;s &#8220;Christmas in Rockefeller Center&#8221; special over an impasse negotiating a new labor contract. The union accuses the network of unfair bargaining practices.</li>
<li>The FTC is <a href="http://online.wsj.com/article/SB10001424052748704107104574569661532881656.html?mod=WSJ_hpp_MIDDLTopStories">examining how government might support journalism</a>, from making news-gathering companies exempt from antitrust laws to granting them special tax treatment to making changes in copyright law.</li>
<li>A mixed martial arts promoter is <a href="http://www.courthousenews.com/2009/12/02/DMX.pdf">suing</a> DMX and his management team for $1 million after the rapper backed out of a planned fight. The promoter says he gave DMX a $6,000 advance to prove his &#8220;tough guy&#8221; persona, but that the rapper wanted him to &#8220;fix&#8221; the fight.</li>
<li>Dean Martin&#8217;s ex-wife is <a href="http://www.courthousenews.com/2009/12/02/Dean_Martin_s_Ex_Sues_Trustee_for_Royalties.htm">suing to regain agency commissions</a> held by the family trust. Jeanne Martin says that obligations to pay agency fees ended after Martin&#8217;s agent, Mort Viner, died in 2003, but that the trust has held onto $130,000 in commissions.</li>
<li>The Vanderbilt Journal of Entertainment &amp; Technology law is poking holes in the <a href="http://www.thresq.com/2009/12/andy-warhol-film.html">lawsuit</a> we reported on yesterday concerning a New Jersey man suing Andy Warhol and Paul Morrissey for exploitation. The author <a href="http://jetl.wordpress.com/2009/12/01/dreamland-choo-choo-derailed-family-sues-warhol-and-morrissey-for-fathers-involvement-in-1964-film/">points out</a> that the movie in question was shot in 1964 as a &#8220;short anti-drug film,&#8221; years before the first federal laws aimed at child pornography were enacted.</li>
<li>At a legal conference in the U.K. yesterday, a High Court judge knocked the concept of &#8220;libel tourism,&#8221; <a href="http://www.telegraph.co.uk/news/newstopics/politics/lawandorder/6703322/Libel-tourism-is-a-phenomenon-invented-by-the-press-says-Mr-Justice-Eady.html">saying that</a> the press has invented the so-called phenomenon of plaintiffs rushing to British court to try defamation claims. Um, <a href="http://www.thresq.com/2008/03/authors-attempt.html">we beg to differ</a>.</li>

<li>A New Jersey individual and his family are suing the Andy Warhol Foundation for the Visual Arts and director Paul Morrissey over a film produced by The Factory in the 1960s called &#8220;All Aboard to Dreamland Choo Choo.&#8221; According to the <a href="http://www.courthousenews.com/2009/11/30/ENT%200110%20Andy%20Warhol.pdf">complaint</a>, plaintiff Richard Toelk starred in the film at the age of 14 and was allegedly abused by drugs and torture. Toelk&#8217;s family accuses Warhol and Morrissey of continuing to make money off of a film that violated child pornography laws.</li>
<li>&#8220;The View&#8221; co-host Elisabeth Hasselbeck is being <a href="http://www.allheadlinenews.com/articles/7017140485">sued for the second time</a> by the author of a gluten-free survival guide who alleges Hasselbeck&#8217;s book on the topic infringed her own. Earlier in the month, a Massachusetts court dismissed Susan Hassetts&#8217; claim, but the plaintiff has now filed a more detailed complaint.</li>
<li>New York actor Charles Buckley is suing producers of the now-cancelled ABC show &#8220;The Unusuals&#8221; after <a href="http://www.nydailynews.com/ny_local/queens/2009/11/30/2009-11-30_actor_down__ouch_tv_bit_player_sues_for_injuries_after_hes_bodyslammed_onto_conc.html">allegedly suffering injuries</a> related to seven body slams he received during the course of filming. Buckley played a gang member caught by a New York SWAT officer.</li>
<li>The New York Post has been hit with another lawsuit alleging racial discrimination. Austin Fenner, who was fired on November 9 after saying he expressed opposition to a Barack Obama cartoon, has <a href="http://www.courthousenews.com/2009/12/01/Second_Journalist_Accuses_NY_Post_of_Racism.htm">filed a federal complaint</a> claiming &#8220;racial animus&#8221; at the Post. The lawsuit comes two weeks after another NYP editor, Sandra Guzman, made <a href="http://www.thresq.com/2009/11/hollywood-docket-beyonces-court-date-sesame-street-lawyers-googles-creepy-line.html">sensational allegations of racism and sexism</a> at the paper.</li>
<li>In England, <a href="http://news.bbc.co.uk/2/hi/uk_news/england/london/8383473.stm">two rappers have been jailed</a> after creating a music video posted to YouTube that was allegedly made to warn people from talking to police about a murder. The rappers were found guilty of acting to pervert the course of justice with their speech.</li>

<p>Summit Entertainment is certainly pleased that &#8220;The Twilight Saga: New Moon&#8221; is approaching the $500 million mark in global boxoffice. But the film has also become a hot commodity in piracy circles.</p>
<div>On Thanksgiving eve, lawyers for the studio filed a lawsuit against unidentified individuals who allegedly uploaded the film to YouTube (<em>UPDATED</em>: Summit tells us the uploaded footage was a portion of the film used in promotional spots). Summit also requested that a California district court issue a subpoena to YouTube for information relating to the identification of those allegedly responsible for uploading the movie. <div>Soon after the video was posted, Summit informed the video-sharing website of the presence of &#8220;New Moon&#8221; on its servers. The movie was taken down.</div>

<div>In the past, YouTube has complied with subpoenas related to user uploads. For example, in 2007, after a court issued a subpoena, <a href="http://www.internetnews.com/xSP/article.php/3659401">YouTube helped Fox identify two individuals</a> who had uploaded entire episodes of the show &#8220;24.&#8221; It&#8217;s unclear whether YouTube will fight Summit&#8217;s latest request for information. The company hasn&#8217;t responded to our request for comment.</div>

<div>In addition to breaking boxoffice records, last week &#8220;New Moon&#8221; also became <a href="http://torrentfreak.com/top-10-most-pirated-movies-on-bittorrent-091130/">the most pirated movie</a> on BitTorrent. The studio is represented in the case by Dennis Wilson at Keats McFarland &amp; Wilson.</div>

<li>Last week, the LA Times <a href="http://latimesblogs.latimes.com/technology/2009/11/avary-twitter-prison.html">reported</a> that &#8220;Pulp Fiction&#8221; screenwriter Roger Avary was tweeting from jail in the midst of serving a one-year sentence for vehicular manslaughter. The story caught the attention of correctional officers, who realized that Avary had been mistakenly assigned to a work furlough program instead of a higher security facility. <a href="http://gawker.com/5414220/pulp-fiction-screenwriter-tweets-from-jail-ends-up-re+imprisoned">He&#8217;s since been moved</a>.</li>
<li>A White House official recently compared censorship in China with the need for net neutrality rules to prevent corporations from acting as gatekeepers of free speech. &#8220;If it bothers you that the China government does it, it should bother you when your cable company does it,&#8221; said Andrew McLaughlin, deputy chief technology officer at the White House. The <a href="http://voices.washingtonpost.com/posttech/2009/11/att_fires_off_at_deputy_cto_mc.html">comment is troubling telecom execs</a>.</li>
<li>A vision-impaired video gamer is suing Sony Corp, arguing that its virtual worlds violate the American with Disabilities Act. Alexander Stern <a href="http://www.scribd.com/doc/22257985/Stern-v-Sony">says the games</a> should add visual and auditory &#8220;cues&#8221; to help him navigate online role-playing games. Before one dismisses him as just another guy trying to game the court system, On Point&#8217;s Julie Edgar offers <a href="http://www.onpointnews.com/NEWS/Gamer-s-Suit-May-Open-Virtual-Worlds-to-Disabled.html">an interesting analysis</a> about why Stern may stand a decent chance in court.</li>
<li>Jared Leto is <a href="http://www.latimes.com/entertainment/news/la-ca-30-seconds-to-mars29-2009nov29,0,7437853.story">paying homage</a> to legendary actress Olivia de Havilland for helping him in his attempts to defend a multi-million dollar lawsuit from EMI over claims his band 30 Seconds to Mars failed to produce an agreed number of albums. <a href="http://www.contactmusic.com/news.nsf/story/leto-reached-out-to-de-havilland-over-emi-lawsuit_1124108">Leto says he plans to visit De Havilland</a> in France to mark her landmark 1940s lawsuit that led to service contracts in California being ruled invalid after seven years.</li>

<p>In the 1996 film &#8220;Happy Gilmore,&#8221; Adam Sandler showcases an unorthodox golf swing to win the Tour Championship and save his grandmother&#8217;s home from IRS debt.</p>
<div>A judge in the Supreme Court of Nova Scotia, Canada, has just ruled that the &#8220;Happy Gilmore shot&#8221; <a href="http://www.canlii.org/en/ns/nssc/doc/2008/2008nssc280/2008nssc280.html">breaches a duty of care</a> on the golf course.</div>
<div>In the case, the plaintiff sued after the defendant tried to impress his golfing buddies during a bachelor party outing that included beer, tequila, and marijuana. On the 16th hole, under the influence, Travis Hayter whipped out his &#8220;Happy Gilmore shot,&#8221; which <a href="http://www.slaw.ca/2009/11/20/fore/">the court defined in 2008 as</a> &#8220;running from five to ten feet behind the ball and hitting it on the run.&#8221;</div>
<div>The ball leapt up and struck the plaintiff in the wrist, then in the chest, causing permanent damage to the radial nerve. The plaintiff no longer was able to return to his former work as a woodsman on account of the incident.</div>
<div>&#8220;The defendant&#8217;s behavior was not among the &#8216;natural risks&#8217; of golfing to which the plaintiff can be said to have consented,&#8221; <a href="http://www.canlii.org/en/ns/nssc/doc/2008/2008nssc280/2008nssc280.html">ruled Judge Arthur J. LeBlanc</a>.</div>
<div>Others have have tried the &#8220;Happy Gilmore shot,&#8221; including pro Padraig Harrington, who noted in a <a href="http://www.youtube.com/watch?v=wguFY0DDoAU&amp;feature=player_embedded">Sports Science episode</a> that &#8220;it&#8217;s perfectly legal to use the Happy Gilmore swing on the golf course.&#8221;</div>

<li>More advertisers are suing each other than ever. Lawyers say they are seeing <a href="http://www.nytimes.com/2009/11/22/business/media/22lawsuits.html?_r=1&amp;ref=media">more complaints and lawsuits</a> over false claims and violation of trademarks. Linda Goldstein, a partner at Manatt Phelps &amp; Phillips, says disputes are becoming part of the &#8220;war game&#8221; for marketers.</li>
<li>Radar Online claims to have proof that Jon Gosselin breached his TLC contract. The website posts an audio recording of Gosselin&#8217;s manager <a href="http://www.radaronline.com/exclusives/2009/11/exclusive-audio-caught-tape-proof-jon-gosselin-breached-his-tlc-contract">discussing various deals over the phone</a>.</li>
<li>A lawyer for Roman Polanski <a href="http://www.reuters.com/article/entertainmentNews/idUSTRE5AJ3AJ20091120?feedType=RSS&amp;feedName=entertainmentNews&amp;utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+reuters%2Fentertainment+%28News+%2F+US+%2F+Entertainment%29">told a French newspaper</a> that the jailed director will not agree voluntarily to be extradited to the United States.</li>
<li>The telecom and music industry in Japan is <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3ib1f5c256ca1b29dd966c12afb373446d">experimenting with a new system</a> that will automatically check cell phone web sites for illegal music files. When unauthorized music files are discovered, the music industry will send a request to the source of the illegal files and request the files be deleted.</li>
<li>James A. Roppo, a senior vp at Island Def Jam Records, <a href="http://www.newsday.com/long-island/nassau/aggressive-roosevelt-field-crowd-cancels-bieber-visit-1.1613741">was arrested by police</a> after a melee ensued during a Justin Bieber concert in a New York mall. The arrest was made after the record executive allegedly refused to send out a Twitter message to help disperse the horde.</li>

The court was unconvinced that the technological process used to create &#8220;new&#8221; recordings entitled Bluebeat to a copyright claim over the Beatles catalogue. <a href="http://latimesblogs.latimes.com/music_blog/2009/11/music-download-site-bluebeat-hit-with-a-preliminary-injunction-sites-founder-responds.html">Bluebeat.com owner says he&#8217;s &#8220;shocked&#8221;</a> at the ruling because the company &#8220;worked with EMI directly, and the RIAA, in secret agreements to create these works lawfully.&#8221;</li>
<li>Turner Broadcasting has <a href="http://www.law.com/jsp/tal/digestTAL.jsp?id=1202435593934&amp;hbxlogin=1">asked a Georgia appeals court</a> to overturn a $281 million jury verdict — the largest in state history — tied to a broken agreement that Turner made to sell two professional sports franchises to a Texas businessman. Lawyers for Turner are arguing that it&#8217;s inconceivable that such a major transaction would be based on an oral agreement.</li>
<li>Nu Image and First Look Studios <a href="http://www.chron.com/disp/story.mpl/metropolitan/6718063.html">won&#8217;t have to destroy</a> DVD copies of their film &#8220;Finding Rin Tin Tin: The Adventure Continues.&#8221; The owner of a Rin Tin Tin museum, who holds the trademark over the phrase, sued the film companies, but a Texas district judge has ruled that the film&#8217;s title is descriptive of a historical subject, and thus is fair use.</li>
<li>&#8220;Girls Gone Wild&#8221; creator Joe Francis is now out of prison, but things aren&#8217;t going much better for the troubled adult entertainment visionary. The IRS has filed a <a href="http://www.tmz.com/2009/11/18/joe-francis-tax-lien-girls-gone-wild-debtor-irs/">federal tax lien against Francis</a> for $34 million.</li>
<li>Speaking of adult entertainment, Vivid Entertainment acquired the Carrie Prejean sex tape. Vivid is offering Prejean $1 million for the right to distribute the tape, and <a href="http://www.xbiz.com/news/114934">Prejean&#8217;s lawyer is threatening to sue</a> the porn company for invasion of privacy, publicity rights, public disclosure of private facts and intentional infliction of emotional distress.</li>
<li>Edgar Wright, director of Shaun of the Dead and Hot Fuzz, <a href="http://www.guardian.co.uk/media/mediamonkeyblog/2009/nov/19/edgar-wright-the-times">is not happy</a> that <em>The Times</em> of London took a tribute to the late actor Edward Woodward he penned on his blog and reprinted his words without permission as a featured column.</li>

<li>Comcast has met with Justice Department officials in consideration of intervening in a proposed merger between Ticketmaster and Live Nation, <a href="http://www.thestreet.com/_yahoo/story/10627586/1/comcast-works-with-ticketmaster-live-nation.html?cm_ven=YAHOO&amp;cm_cat=FREE&amp;cm_ite=NA">Bloomberg reports</a>. Government officials have been reviewing the merger under antitrust concerns that it would result in too much control over ticket prices, and Comcast may salvage the merger by agreeing to purchase spinoffs from the companies.</li>
<li>A federal judge in Massachusetts has <a href="http://www.thebostonchannel.com/entertainment/21636546/detail.html">dismissed a lawsuit</a> that accuses &#8220;The View&#8221; co-host Elisabeth Hasselbeck of plagiarizing another author&#8217;s work for her own best-seller &#8220;The G-Free Diet: A Gluten-Free Survival Guide.&#8221;</li>
<li>Shazam, the uber-popular iPhone app that lets users identify songs being played anywhere, is the subject of a patent lawsuit. <a href="http://www.businessinsider.com/shazam-sued-for-patent-infringement-2009-11?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+typepad%2Falleyinsider%2Fsilicon_alley_insider+%28Silicon+Alley+Insider%29&amp;utm_content=Google+Reader">Digimarc has filed a lawsuit</a> against Shazam Entertainment over the iPhone app that claims more than 50 million users in over 150 countries.</li>

<li>IMAX is suing its former partner Cinemark in New York County Court, <a href="http://www.courthousenews.com/2009/11/16/Imax.pdf">claiming</a> the theater chain stole trade secrets and breached a contract by attempting to reproduce a &#8220;bootleg version of the IMAX Experience.&#8221; The plaintiff claims it introduced its &#8220;wrap around&#8221; theaters and disclosed &#8220;confidential and sensitive information regarding the IMAX immersion theatres&#8221; to Cinemark when the two companies were partners in the 1990s. Recently, Cinemark came out with its own brand of big theaters called the XD.</li>
<li>Google and book publishers have <a href="http://news.aol.com/article/google-makes-concessions-on-digital-book/633166?v=aolrssdf">entered a revised settlement agreement</a> into federal court in an attempt to win approval. The new agreement provides concessions for other companies to license Google&#8217;s digital collection of copyrighted out-of-print books, a trustee responsible for orphan works, geographical restriction upon Google, and more. The agreement hasn&#8217;t warmed some critics, who are <a href="http://www.eff.org/deeplinks/2009/11/google-book-search-settlement-revised-no-reader-pr">knocking the lack of privacy protections</a>. On Twitter, there&#8217;s a great conversation going about the merits of the revised deal at <a href="http://twitter.com/search?q=%23GBS">#GBS</a>. A federal judge is soon expected to set a date to hear arguments about whether to approve the settlement.</li>
<li>Five North Carolina police officers have <a href="http://www.aoc.state.nc.us/www/public/coa/opinions/2009/pdf/081469-1.pdf">lost an appeal</a> of a judge&#8217;s order dismissing some slander and libel claims against Jayceon Taylor, the hip hop artist known as The Game. The police sued after a concert DVD and statements to the press described footage of the rapper purportedly being &#8220;wrongfully arrested and brutalized by the Police in North Carolina&#8221; before a concert.</li>
<li>If Comcast purchases a big stake in NBC Universal, as expected, what will the new company be called? One clue may be domain name registration. <a href="http://www.broadcastingcable.com/blog/BC_Beat/26171-Comcast_NBC_U_Domain_Deja_vu_An_Update.php">Broadcasting &amp; Cable notes</a> that Comcast has recently registered ComcastNBCU.com, NBCUComcast.com, ComcastNBCUniversal.com, and other websites. We&#8217;re happy Comcast&#8217;s lawyers are thinking ahead to avoid silly cyber-squatting fights.</li>
<li> If you look up the word, &#8220;schadenfreude&#8221; in the entertainment lawyer&#8217;s handbook, you&#8217;ll see <a href="http://torrentfreak.com/iconic-pirate-bay-ship-logo-hijacked-by-private-company-091116/">this story</a> — a private Swedish company has registered the famous logo of The Pirate Bay as a trademark. The company intends to use the image to sell USB drives while the ol&#8217; piracy hub attempts to get the Sweden&#8217;s Patent and Registration Office to annul the registration.</li>

The musicians are suing the publication for misappropriating their likenesses for commercial purposes by featuring a spread entitled, &#8220;Indie Rock Universe&#8221; next to a four-page advertisement for Camel cigarettes. The appeals court will decide whether the story constitutes pure free speech or commercial speech.</li>

The A&amp;E show &#8220;City Confidential&#8221; featured the University of Tennessee marching band performing the song for 12-14 seconds. The court ruled that it was too early to determine whether the song&#8217;s use was transformative.</li>

<p>Captain Morgan may have pulled off the quietest and shortest-lived advertising ambush in sports history last Sunday. One that was almost universally unknown, barely noticed, and yet, promptly squashed by the NFL this week.</p>
<p>Like the other 21.9 million viewers watching the <a href="http://sports.yahoo.com/nfl/teams/dal/;_ylt=AkedBfDXdI7boHq.xjVS1DnhMMQF">Dallas Cowboys</a> face the <a href="http://sports.yahoo.com/nfl/teams/phi/;_ylt=AnP9K.4LdeKeH1MnQ1tYT9XhMMQF">Philadelphia Eagles</a> on Sunday night, you probably missed it. But the brand name known for spiced rum achieved the rare feat of sneaking an advertising fastball by the NFL – in the middle of a nationally televised game, no less. During the third quarter of Dallas’ 20-16 win, Eagles tight end <a href="http://sports.yahoo.com/nfl/players/8416/;_ylt=ArV0n81w3bSN2pO9dfvdpXnhMMQF">Brent Celek</a><a id="ysp_playernote_nfl.p.8416" href="http://sports.yahoo.com/nfl/players/8416/news;_ylt=AltrXDD6F7Dep3YE4BnoIrfhMMQF">(notes)</a> caught an 11-yard touchdown pass from <a href="http://sports.yahoo.com/nfl/players/4650/;_ylt=ArH_cWZIF_Y9NtKS5nXsy4HhMMQF">Donovan McNabb</a><a id="ysp_playernote_nfl.p.4650" href="http://sports.yahoo.com/nfl/players/4650/news;_ylt=AhmW.xzEp1FeJCywrjOFxyfhMMQF">(notes)</a>, then appeared to purposefully back up and align himself in front of television cameras. Putting his hands on his hips, Celek raised his right leg, mimicking a pose similar to the pirate on Captain Morgan’s label.</p>
<p>As far as anyone knows, it’s the first time we’ve seen that type of guerilla-style advertising campaign in an NFL end zone. And if the league has its way, it will be the last, too. The “Captain Morgan” was effectively banned this week after the league learned of a wider campaign meant to get players to repeatedly strike the pose during NFL games.</p>
<p>“A company can’t pay a player to somehow promote it’s product on the field,” NFL spokesman Greg Aiello told Yahoo! Sports this week. “Every league has the same rule. … It’s come up before, companies trying to use our games and then players for ambush marketing purposes.”</p>
<p>Celek’s pose actually resulted in a 15-yard penalty for demonstration, which was incurred when teammate <a href="http://sports.yahoo.com/nfl/players/7858/;_ylt=ArzuP1xUe0jtFPJPYObFpOnhMMQF">Jason Avant</a><a id="ysp_playernote_nfl.p.7858" href="http://sports.yahoo.com/nfl/players/7858/news;_ylt=As41rVASUWKy0hffs1wXdPnhMMQF">(notes)</a> tried to help him achieve the perfect Captain Morgan form. Afterward, Celek spoke through an Eagles spokesman and denied any knowledge of a Captain Morgan campaign. But an account executive handling the promotion told Yahoo! Sports the Eagles tight end was indeed involved.</p>
<p>In hopes of raising brand awareness, Captain Morgan intended to offer lucrative charity contributions in exchange for each instance a player was caught on camera doing its pose during a game. The contributions were earmarked for the Gridiron Greats Assistance Fund – a non-profit which helps retired NFL players with various hardships after leaving the game.</p>
<p>“The [ad campaign] has been going around internally for a while and [Celek] learned of the program through his contact at Diageo [Captain Morgan’s parent company],” said Glenn Lehrman, an account director at Rogers &amp; Cowan, the Los Angeles-based firm that handles Captain Morgan promotions. “Brent said, ‘You know what, if I get the opportunity, I’m going to go ahead and do it.’ He sort of beat us to the punch, but we’re certainly not going to complain.”</p>

<p>The first player to be suspended by the PGA Tour for testing positive for a performance-enhancing substance was asking a federal court Friday to lift his suspension.</p>
<p>An attorney for golfer <a href="http://sports.espn.go.com/golf/players/profile?playerId=24">Doug Barron</a> said a hearing was being held Friday morning in U.S. District Court in Memphis on a lawsuit filed the day before seeking an immediate injunction from the court to let him play.</p>
<p>Lawyer Jeffrey Rosenblum said Barron was seeking a decision in time to compete in the PGA Tour Qualifying Tournament next week.</p>
<p>Barron, a 40-year-old journeyman who lives in Tennessee and lost his tour card three years ago, was suspended this month for one year. Under its doping policy, the tour announces a suspension but does not disclose what substance a player used.</p>
<p>In court documents, the PGA said Barron was tested on June 11 during the St. Jude Classic in Memphis and the sample was positive for propranolol, a beta-blocker, and testosterone.</p>
<p>Andrew Levinson, the executive director of the tour&#8217;s anti-doping program, said in court documents that Barron had sought prior approval from the tour to use the substances based on medical needs, but his applications were denied.</p>
<p>But according to the lawsuit, the PGA Tour was aware Barron had been taking beta blockers when he was tested at the St. Jude Classic &#8212; the only tour event he played this year.</p>
<p>On Nov. 2, the tour announced his suspension for one year, a surprise to many players who knew Barron.</p>
<p>&#8220;I&#8217;ve never tried to gain any advantage over my peers,&#8221; Barron said, according to the Memphis Commercial Appeal.</p>
<p>According to media reports, in the suit, Barron said he has been taking beta blockers for a heart condition for 22 years and testosterone shots for low testosterone since 2005 &#8212; both prescribed by doctors.</p>

<p>USA Today is reporting today that Boise State has officially formed a non-profit corporation and will begin selling shares to the public at $100 per share in hopes of raising $20 million (<em><a href="http://www.usatoday.com/sports/college/2009-11-11-boisestate-stock_N.htm">Boise State Athletic Department Hopes Stock Offering Raises $20 Million</a></em>). AD Gene Bleymaier said, &#8220;If we are to continue the success we are enjoying now we must generate new revenues to pay for coaches&#8217; salaries, scholarships and facilities.&#8221; The shares will not pay dividends, but shareholders can vote on members of a 12-person board at an annual meeting and the board will determine how money raised through the offering would be spent. Bleymaier also said this fundraising program mirrors the offering made by the Green Bay Packers when they raised $24 million in the sale of more than 105,000 shares back in 1997.</p>
<p>If this is true, needless to say, it&#8217;s a very interesting development. One would certainly think this has to violate some provision, somewhere, in that 437-page NCAA Bylaw manual. It also raises all kinds of interesting corporate law questions in the context of fiduciary duties, state and federal securities regulations and non-profit corporation laws, just to name a few. The more I think about it, this has to be a joke, right?</p>
<p>Perhaps Boise State is just trying to make a point, and if so, their point is well-taken because this is no different than what is already taking place in big-time intercollegiate athletics. The only difference is that we call them boosters, not shareholders.</p>
<p>This new development also relates to the topic of my article I posted on two days ago because the proceeds generated from this stock sale are earmarked to fund coaches&#8217; salaries. Boise State along with Cincinnati and TCU are prime candidates to have their successful football coaches solicited by competitor schools, making them soon-to-be victims of both tortious interference and breach of contract. The presidents of these three schools have a choice. They can either pay their coaches more money or let them go and then proclaim that they are &#8220;powerless&#8221; to do anything about rising salaries. Or, they can exercise their legal rights and stand up for all the current and prospective student-athletes who committed to their school in reliance on the fact that their coach was obligated to be there for a period of years&#8230;.the same student-athletes who, unlike their coach, are prohibited from transferring to another school.</p>

<li>AmLaw Daily <a href="http://amlawdaily.typepad.com/amlawdaily/2009/11/the-lawyers-of-sesame-street.html">interviews two lawyers</a> behind the scenes of  &#8220;Sesame Street&#8221; on the show&#8217;s 40th anniversary. Muppet acquisition and muppet infringement are just two of the things that have made the show tick through the years.</li>
<li>Former New York Post editor Sandra Guzman has filed a <a href="http://gawker.com/5401475/the-new-york-post-is-a-hellish-cauldron-of-racism-sexism-and-white-rage-lawsuit">scathing 38-page complaint</a> that accuses The New York Post and its top editor of explicit racism and sexism. Guzman says virtually all of the paper&#8217;s employees are white men and accuses some of the paper&#8217;s executives and editors of specific lewd acts.</li>
<li>In March, Playboy&#8217;s &#8220;Lawyer of Love&#8221; columnist Corri Fetman  <a href="http://www.thresq.com/2009/03/playboy-february-covergirl-lawyer-of-love-lawsuit.html">sued the publication</a> for $4.5 million for sexual harassment. Now, Playboy has filed a <a href="http://newsblogs.chicagotribune.com/chicago-law/2009/11/playboy-sues-chicago-divorce-lawyer-corri-fetman-known-for-racy-billboard.html">trademark suit against Fetman</a> for stealing the phrase &#8220;Lawyer of Love&#8221; from them.</li>
<li>EMI Music has appointed Kyla Mullins as its <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3i9ba793168e904e3e088abcbdee34d120">new general counsel</a>. She was most recently group legal director at ITV.</li>
<li>Over the years, many lawyers have been curious about how much consideration Google pays to copyright and privacy law when conducting new business ventures. According to CEO Eric Schmidt, the company pays attention to what he calls &#8220;<a href="http://news.cnet.com/8301-30684_3-10392435-265.html">the creepy line</a>,&#8221; a quasi-ethical ick factor, when deciding what to do next. For example, Google only publishes satellite data for Google Maps that&#8217;s a month old rather than in real-time.</li>

Anthony Falzone, executive director of the Fair Use Project at Stanford University, wishes to withdraw representation of Fairey after the artist acknowledged mistakes about the AP photo he used.</li>

<li>Wired has <a href="http://www.wired.com/threatlevel/2009/11/acta/">published</a> the confidential Anti-Counterfeiting Trade Agreement. The international treaty, which would impose new measures to crack down on piracy, has been subject to much speculation from lawyers, some of whom believe the agreement will <a href="http://www.thestar.com/entertainment/article/722454--still-murky-copyright-treaty-could-change-web-as-we-use-it">change the Internet as we use it</a> and others who believe <a href="http://www.out-law.com//default.aspx?page=10507">it&#8217;s not really that big a deal</a>. Negotiations over the treaty continue in January in Mexico.</li>
<li>Google and book publishers <a href="http://voices.washingtonpost.com/posttech/2009/11/google_and_book_authors_and.html">will soon present a revised settlement agreement</a> concerning digital rights. Since announcing a settlement last year over Google&#8217;s efforts to scan library books, the agreement has come under intense attack and Justice Department review.</li>
<li>Jennifer Lopez&#8217; lawyers are in court today in <a href="http://www.thewrap.com/ind-column/jennifer-lopez-lawyers-aim-block-home-video-release-9839">an attempt to get a restraining order</a> to stop a home movie and other future projects from former J-Lo hubby, Ojani Noa.</li>
<li>David Letterman&#8217;s alleged blackmailer may not cut a plea bargain. Sources tell the NY Observer that Joe Halderman is <a href="http://www.observer.com/2009/media/david-lettermans-alleged-blackmailer-headed-court-sources-say-halderman-intent-trial-rais">raising a lot of money</a> to mount a vigorous defense.</li>
<li>Dreamworks Animation general counsel Katherine Kendrick <a href="http://www.hollywoodreporter.com/hr/content_display/film/news/e3iec91181b3bb41981223490075d20e60a">will leave the company</a> at year&#8217;s end to pursue philanthropic efforts.</li>
<li>Nick Counter, the lead labor negotiator for Hollywood studios, <a href="http://www.hollywoodreporter.com/hr/content_display/film/news/e3iec91181b3bb41981d514f51083e41387">died</a> at the age of 69. Before serving as president of AMPTP for 27 years, he was outside counsel at the Motion Picture &amp; Television Producers. <li>No Doubt is suing Activision Blizzard over the <a href="http://www.billboard.com/#/news/no-doubt-sues-activision-over-band-hero-1004034404.story">use of the band&#8217;s likeness</a> in the game &#8220;Band Hero.&#8221; According to the lawsuit, the band had a licensing agreement with Activision, but the videogame maker went out of bounds by allowing game-players to have No Doubt perform songs by other bands and do other crazy stuff. <li>Capitol Films top executives David Bergstein and Ron Tutor are facing more legal trouble. The pair are <a href="http://www.hollywoodreporter.com/hr/content_display/film/news/e3iebd54eb8221fdcda00fc56152fa35a87">being sued by a group of investors</a> who provided most of the money for the company to make and sell films. The plaintiffs seek reimbursement of about $120 million, citing personal guarantees on loans made by the executives.</li>
<li>The MPAA is barking at the FCC&#8217;s door with various requests. On Wednesday, the movie industry association <a href="http://www.hollywoodreporter.com/hr/content_display/film/news/e3i5262a3b026dcf1719c6f93d84ba80d3d">filed a brief pushing for a waiver</a> to be allowed to implement selectable-output control technology to disable less-secure analog outputs on HDTV sets. The MPAA argues that the move would allow studios to securely transmit first-run movies sooner to consumers. Last Friday, the MPAA sent the FCC another letter that <a href="http://www.wired.com/threatlevel/2009/11/mpaa-filtering/">recommended the agency adopt rules</a> encouraging ISPs to get tough on pirates, including disconnecting repeat offenders.</li>
<li><a href="http://news.bbc.co.uk/2/hi/entertainment/8342277.stm">EMI is suing Bluebeat.com</a> for selling unauthorized digital music from The Beatles. Many were surprised when the US website began offering Beatles tracks for 25 cents since the band and label have never been able to reach an agreement with Apple&#8217;s iTunes store.  The defendant is offering an <a href="http://copyrightsandcampaigns.blogspot.com/2009/11/introducing-psycho-acoustic-simulation.html">extremely unusual defense</a>, basically arguing they own the copyrights to the works it sells.</li>
<li>IATSE has <a href="http://latimesblogs.latimes.com/entertainmentnewsbuzz/2009/11/iatse-and-afi-settle-labor-dispute.html">reached a settlement</a> with the American Film Institute over accusations the latter attempted to discourage concession workers from joining the union. The deal ensures that the AFI Fest in Los Angeles will go off without labor strife.</li>
<li>We now know the answer to the question: Is there anything TMZ wouldn&#8217;t post? Miss California USA Carrie Prejean has <a href="http://www.cnn.com/2009/SHOWBIZ/11/04/miss.california.usa.settlement/index.html?eref=rss_topstories">settled a lawsuit with pageant officials</a> after reported revelations of a &#8220;sex tape.&#8221; <a href="http://www.tmz.com/2009/11/04/carrie-prejean-sex-tape-settlement-miss-california-usa-pagneat/">TMZ says</a> it obtained the &#8220;video months ago but decided not to post it because it was so racy.&#8221;</li>
